These terms are between you and 12871785 Canada Inc. o/a DreamEdit ("DreamEdit", "we", "us"). DreamEdit is a business name of that corporation. By creating an account or using DreamEdit, you agree to these terms. If acting for a business, you confirm you can bind it. Our Privacy Policy explains how we handle personal information.
Nothing here removes consumer rights or remedies that cannot legally be waived.
1. What DreamEdit is
DreamEdit uses third-party AI models to create and edit images and produce other results. We and our licensors own the service, software, and branding. You may use DreamEdit for personal or business purposes under these terms.
2. Your account
You must be at least 18 and legally able to enter this agreement. Keep account information accurate and sign-in details secure. You are responsible for your use and anyone you authorize. Tell us promptly about unauthorized access. Do not share accounts or create extra accounts for additional trials.
3. Your content
You keep your rights in uploads and messages. We assign you any rights we have in results, to the extent the law allows. This does not grant rights owned by others. Commercial use is subject to the applicable model rules in section 4.
You must have the rights and permissions needed for your content and use of results, including people's likenesses and personal information. You grant us a worldwide, non-exclusive, royalty-free license to store, copy, process, and display content, including through our providers, only to provide and secure DreamEdit, handle support, and comply with law as described in our Privacy Policy. This permission lasts while we lawfully retain content for those purposes.
We may use your feedback without payment or other obligation.
4. Rules
Do not:
- Break the law, infringe others' rights, commit fraud, impersonate others, or create deceptive evidence.
- Exploit or sexualize minors, create non-consensual intimate content, or threaten, harass, or promote violence or hatred.
- Submit sensitive personal information such as medical records, financial account numbers, or government identifiers.
- Evade safety filters, charges, or limits; access others' content; or interfere with our systems.
- Scrape, automate, reverse engineer, or resell DreamEdit without permission, except where law permits, or use results to develop a competing AI model or service.
- Remove AI provenance markers or misrepresent results to deceive others. Follow legal disclosure requirements.
Follow applicable AI service terms, model-specific rules, and trade restrictions. Requests may be refused for safety, legal, or policy reasons. We may investigate abuse and report illegal activity as required by law.
5. About AI results
Review results before using or publishing them. They may be inaccurate, offensive, unsuitable, or similar to others' results. We do not guarantee originality, copyright protection, or freedom from third-party claims. Results are not professional advice. You are responsible for their use.
6. Credits, subscription, and payment
- Trial. Eligible new users receive one free trial after email verification. Trial credits expire after 30 days. No card is required and there is no automatic paid subscription.
- Subscription. Price, currency, and allowance are shown before purchase. You authorize monthly charges to your selected payment method until cancellation. Unused monthly credits expire each billing period and do not roll over.
- Usage. Images, editing, and messages use credits. Costs vary by model and settings; estimates are not guarantees. Processing may use credits even for refused or unsatisfactory results.
- Extra credits. Available to active subscribers not scheduled to cancel. They expire 12 months after purchase unless law requires otherwise, and remain usable after subscription cancellation.
- Cancellation. Open Billing in account settings, then Manage billing. Cancellation stops the next renewal; your current paid period continues. Contact us if you cannot access billing. Simply stopping use does not cancel.
- Refunds. Payments are non-refundable except as required by law or section 7. Credits cannot be transferred or redeemed for cash, subject to those exceptions.
- Changes and payment issues. We will notify you of price or plan changes before renewal, with time to cancel and any legally required consent. Failed or reversed payments may restrict paid features or remove associated credits.
7. Suspension and ending your account
You may request account deletion by email. We may restrict access, remove content, or close accounts for breaches, non-payment, legal requirements, or reasonable security or safety concerns, with notice where practical and lawful.
Unused credits may be forfeited for your breach only where legally permitted. If we permanently end a paid service for another reason, we will refund unused prepaid amounts for service we will no longer provide. Download results you want to keep before closing your account.
8. Copyright and abuse reports
Email hello@dreamedit.com with your contact details, the issue, and enough information to locate the content. We may remove content and close accounts, including those of repeat infringers.
9. Service availability and warranties
To the extent law allows, the service and results are provided "as is" and "as available", without express or implied warranties, including merchantability, fitness for purpose, or non-infringement. We do not guarantee uninterrupted service or that content will never be lost. Keep your own copies.
Models, features, and limits may change or become unavailable. Material paid-plan changes remain subject to sections 6 and 7 and your legal rights.
10. Limit of liability
To the fullest extent law allows:
- 12871785 Canada Inc., its affiliates, directors, officers, employees, contractors, and providers are not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, revenue, data, or goodwill.
- Their combined liability for all claims related to DreamEdit is limited to the greater of US$100 or what you paid DreamEdit in the 12 months before the event giving rise to the claim.
These limits apply under any legal basis, including negligence, even if loss was foreseeable. They do not limit fraud or liability that cannot legally be limited.
11. Claims arising from your use
Where law permits, you will cover reasonable losses and legal costs of the parties protected in section 10 from third-party claims caused by your unlawful content, misuse of results, or breach of these terms, excluding their own unlawful conduct. We may control the defence; you must reasonably cooperate. Settlements requiring your admission of fault or non-monetary action need your consent.
12. Changes to these terms
We will give reasonable advance notice of material changes, except for urgent legal or security reasons. Changes apply from their effective date onward. We will obtain consent where required; otherwise, continued use after the effective date means acceptance. You may stop using DreamEdit and cancel if you disagree.
13. General
Ontario law and applicable federal Canadian law govern these terms. Ontario courts have exclusive jurisdiction except where mandatory local law gives you other rights.
These terms, applicable purchase details, and referenced AI service terms and model rules form our service agreement. Unenforceable provisions do not affect the rest. Not enforcing a term does not waive it. You need our consent to transfer this agreement; we may transfer it with our business without reducing your legal rights.
Content rights, unpaid amounts, liability, third-party claims, and dispute provisions survive termination. The parties protected in section 10 may enforce their protections.
